The following is a standard contract which will be tailored to the online inspection process of forwarding scanned or digital jpeg, adobe or other pictures of:
1. Your home under construction, or 
2. Home purchase contract, or
3. Any financially related documents.

INSPECTION CONTRACT

 

SCOPE OF INSPECTION

Our inspection is limited to a casual inspection of the building which is pictorially exposed to view. This inspection will not entail any examination of covered or hidden areas including but not limited to interiors of walls, ceilings, foundations, soffits, underground plumbing, gas or electric. The Client acknowledges and agrees that this on line inspection and written report does not cover any concealed defects nor does it include any destructive testing, dismantling of equipment, systems or exposed surfaces. The Client agrees to assume the risk of any concealed defects in the building which are not apparent on visual inspection. This inspection and report are not a substitute for a Structural Pest control Inspection and we recommend that the Client obtain a report from a Licensed Pest control Inspector.

Our report does not warrant or guarantee the building or any of its parts nor is it a guarantee that the building complies with building and planning departments as the zoning and status of any permits, pending actions or violations on the subject property.

EXCLUSIONS:

Home Engineering Service does not check the following items:
1. Stoves, refrigerators, dishwashers, garbage disposal, trash compactors, fixed appliances;
2. Alarms, security systems, intercoms;
3. Heating and cooling system efficiencies;
4. Outdoor spas or swimming pools;
5. Utilities not on, sealed service panels;
6. Plugs blocked by furniture or appliances;
7. Stove/fireplace flues, draw of fireplace;
8. Air conditioning during cold weather;
9. Water quality;
10. Accuracy of timers/thermostats;
11. Solar systems, exterior hot tubs;
12. Flooring beneath floor covering;
13. Heat exchangers in furnaces;
14. Toxic substance testing or identification;
15. Inaccessible/hazardous area;
16. Soil stability
17. Integrity of waterproof membranes
18. Fire escapes

LIMITS OF LIABILITY

The Client acknowledges and agrees that an inspection and report guaranteeing the condition of the property would cost 3% of the property’s fair market value. In consideration for the reduced charge agreed upon for this inspection report, the Client agrees that Home Engineering Service shall not be responsible for any defective conditions in the property which are not discovered, unless we have committed gross negligence or willful misconduct.

Except for willful misconduct or gross negligence, the liability of the inspection company for damages arising out of, or in any way connected with, error or omissions in the inspections and/or report, shall be limited to the cost of the inspection and/or report. Refund of the inspection and/or report fee shall be accepted by the undersigned Client in full settlement of all claims and the inspection company shall thereupon be generally released. The undersigned waives all rights under Section 1542 of the California Civil Code, which reads as follows: “A general release does not extend to claims which the creditor does not know of, suspect to exist in his favor at the time of execution the release, which if known to them must have materially affected their settlement with debtor.”

ARBITRATION

It is agreed by the undersigned Client that all disputed and claims of liability arising out of the inspection of the report shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, except that the dispute shall be determined by an arbitrator who is knowledgeable in and familiar with the professional building inspection industry and will follow substantive rules of law.

The undersigned hereby orders a visual inspection of the building named below to be conducted by HOME ENGINEERING SERVICE for the sole use and benefit of the undersigned. Under no circumstances shall this inspection report be deemed for the benefit of any third party nor shall it constitute a warranty of any nature, express or implied:
